Court Sets Date in Suit to Reopen Mohbad Death Investigation

Nearly three years after the death of Afrobeats star Mohbad, a Federal High Court in Abuja has fixed September 29, 2026, for judgment in a suit seeking to compel Nigerian police authorities to reopen investigations into the circumstances of his passing.

Justice James Omotosho of the Federal High Court, Abuja, fixed the date on Tuesday following arguments in the matter filed by Break the Silence Foundation, a non-governmental human rights organization that has positioned itself at the forefront of the public clamor for justice in the case.

The suit, brought as a mandamus proceeding, a legal mechanism designed to compel a public authority to perform a duty it has allegedly failed or refused to carry out, lists three respondents: the Inspector-General of Police (IGP), the Nigeria Police Force, and the Commissioner of Police, Lagos State Command.

What was immediately striking at Tuesday’s proceedings, however, was the complete absence of all three respondents when the matter was called before Justice Omotosho.

Not a single lawyer appeared on their behalf, a development that, while not unusual in protracted public interest litigation of this nature, speaks to the kind of institutional disregard that activist groups say has defined the authorities’ handling of the Mohbad case from the very beginning.

Despite the absence of the respondents, the court proceeded with the hearing.

Counsel to Break the Silence Foundation, Tunde Falola, adopted all processes filed on behalf of the organization and urged the court to grant the reliefs sought principally, an order compelling the police to conduct a fresh, comprehensive investigation into the singer’s death.

Speaking to journalists after the proceedings, Falola was candid about what motivated the organization to take the matter to court.

“The organization approached the court because it was dissatisfied with the outcome of the earlier police investigation, arguing that several critical aspects and possible leads were not adequately explored,” he said.

He was particularly pointed in his concerns about individuals who were reportedly among the last people to be seen with the deceased before his death, insisting that their roles required further scrutiny and that investigators had not adequately pursued those lines of inquiry.

“The circumstances surrounding his death remain mysterious and deserve public attention,” Falola told reporters. “As a human rights organization seeking justice, we believe the police should reopen the investigation.”

The proceedings were not without a dramatic subplot. One Samson Obaboye appeared before the court and sought to be joined in the suit as an interested party.

Presenting himself as a citizen deeply invested in the pursuit of truth, transparency, accountability, and justice regarding Mohbad’s death, Obaboye argued that he wished to place relevant facts before the court.

Justice Omotosho, however, was unconvinced, dismissing the application because Obaboye had failed to establish sufficient legal interest in the case to warrant his joining as a party.

Falola, too, took issue with the joinder bid. The counsel argued pointedly that Obaboye had not demonstrated any direct or legal connection to the proceedings; he was neither an established police officer, a named party in the suit, nor someone with a demonstrable personal stake in the matter.

“If every Nigerian were allowed to join the matter without demonstrating a legal interest, it would amount to an abuse of court process,” Falola warned, a caution that underlines the delicate balance between public interest and legal process in a case that has captured the nation’s imagination.

To understand the weight of Tuesday’s hearing, one must revisit the full arc of a story that has haunted the Nigerian music community and the public at large.

Mohbad, a gifted, if troubled, young artist whose music resonated deeply with millions of Nigerian youths, died on September 12, 2023, under circumstances that were never fully explained to the public’s satisfaction. He was just 27 years old.

Such was the public outcry following the announcement of his death that widespread demands for accountability erupted almost immediately across social media and in the streets. His body was buried the very next day, on September 13, 2023, a move that, in hindsight, many viewed as hasty.

Sensing the public pressure and amid swelling calls for a thorough inquiry, authorities exhumed the body on September 21, 2023, barely nine days after burial, to conduct an autopsy aimed at formally determining the cause of death.

Yet nearly three years on, that cause of death remains a matter of public controversy. The autopsy results have not conclusively settled the debate in the court of public opinion. The singer’s remains have yet to be finally interred, a fact that, in itself, is a haunting symbol of a case still very much in limbo.

Through it all, Mohbad’s father, Joseph Aloba, has remained a persistent and grieving voice, consistently calling for justice and demanding that the authorities provide clear answers about how his son died.

With judgment now fixed for September 29, 2026, the court’s decision will be pivotal.

Should Justice Omotosho rule in favor of Break the Silence Foundation and issue the mandamus order, the Inspector-General of Police would be legally compelled to reopen investigations into the case, bringing fresh scrutiny, fresh interviews, and potentially fresh revelations.

Should the court rule otherwise, the foundation would need to determine its next steps in a legal battle it has framed as nothing less than a matter of human rights and public accountability.

For now, as the September date approaches, the family, the fans, the activists, and indeed a significant portion of the Nigerian public will be watching, still waiting, for the truth about what really happened to Mohbad.
