Non-Payment for Waste Collection Now a Criminal Offence, Lagos Govt Says

The Lagos State Government has drawn a hard line against residents who skip out on paying for waste collection, signalling that non-payment will soon carry the weight of criminal law rather than a mere administrative slap on the wrist.

The warning came from the Commissioner for the Environment and Water Resources, Tokunbo Wahab, who used a radio appearance on Friday to lay out both the progress and the pain points of the state’s monthly environmental sanitation exercise, the now-familiar ritual that shuts down parts of Lagos for a few hours so residents can clean their surroundings.

At the heart of Wahab’s remarks was a blunt diagnosis: too many Lagosians are enjoying a service they refuse to pay for. Invoking what he described as a globally accepted standard, the polluter-pays principle, the commissioner argued that Private Sector Participation (PSP) operators, the licensed private companies contracted to handle household waste across the state, are being squeezed by residents who use their services without settling the bill.

That imbalance, he said, is quietly corroding the entire waste management chain, from truck maintenance to disposal capacity. His solution: a rejigged system in which failure to pay is no longer just bad citizenship; it becomes a criminal offence.

Notably, the crackdown on non-paying residents is only one half of the government’s recalibration. In a separate meeting with the Association of Waste Managers of Nigeria a day earlier, Wahab acknowledged that PSP operators themselves need a fairer deal.

The state, he said, is examining the financial sustainability of PSP operations, including how costs are recovered with an eye toward adjustments that would let operators run efficiently rather than limp along underfunded.

But that goodwill came with a warning of its own. Better financing, Wahab insisted, must be matched by transparency and consistent service, and operators cannot hide behind dumpsite congestion or other logistical headaches as an excuse for leaving residents’ bins unemptied.

He pressed waste managers to honour their contracts, keep their trucks roadworthy, and maintain reliable pickup schedules in their designated zones.

The commissioner also turned an unusually self-critical eye on government performance, conceding that officials have identified shortcomings of their own since the sanitation exercise resumed and are working to correct them rather than deflect blame entirely onto residents or operators.

Part of that fix lies underground, quite literally, at the dumpsite level. The government has been investing in upgrades at the Solous dumpsite in Igando, aiming to ease the bottleneck there and cut down the time waste trucks spend queuing, a delay that ripples back through the whole collection system and, ultimately, lands on residents in the form of overflowing bins.

None of this, Wahab suggested, will work without muscle behind it. He called for stronger enforcement to steer residents toward licensed PSP operators and away from the illegal dumping that still scars roadsides and open spaces across the state.

That enforcement push isn’t new rhetoric it has already produced numbers. By May, the state reported that 931 people had been arrested over waste management violations, while 239 facilities were sealed shut following compliance sweeps.

The latest threat of criminal sanctions for non-payment appears to be an extension of that same enforcement muscle, now aimed squarely at household wallets rather than illegal dumpers alone.

The announcement lands just ahead of the next monthly sanitation exercise, scheduled for Saturday, August 29, 2026.

Lagos State says it will keep working closely with waste managers to smooth out operational snags and tighten up collection efficiency across the state even as it prepares to test residents’ willingness to pay, this time with the threat of prosecution hanging over those who don’t.

Whether the policy translates into actual prosecutions or simply improves compliance through deterrence will likely become clearer in the months ahead, as the state finalizes the details of its “rejigged” waste management framework.

Lagos is done letting residents free-ride the waste system. Starting soon, refusing to pay your PSP operator for waste collection won’t just be a bad habit; it will be a criminal offence.

The state is pairing this crackdown with promises to fix operators’ funding and dumpsite bottlenecks, but for the average resident, the takeaway is simple: pay your waste bill, or risk prosecution.
