NBA Slams Lifetime Flight Ban on Ibom Air Passenger, Demands Investigation and Redress

The Nigerian Bar Association (NBA) has strongly criticised the treatment of Ms. Comfort Emmanson, the passenger at the centre of an incident aboard an Ibom Air flight last Sunday, calling it reckless, unlawful, and a violation of fundamental rights.

In a statement jointly signed by NBA President Mazi Afam Osigwe, SAN, and Secretary-General Dr. Mobolaji Ojibara, the body condemned the lifetime flight ban imposed on Ms. Emmanson by both Ibom Air and the Airline Operators of Nigeria (AON), describing the decision as arbitrary, unjust, and a serious affront to the rule of law and human dignity.

The NBA argued that the passenger was denied the right to a fair hearing before the sanctions were imposed, stressing that such actions were heavy-handed and legally indefensible. It demanded an independent investigation into the matter and called for an immediate withdrawal of the ban.

The association also urged the arrest and prosecution of those responsible for recording and sharing unedited video footage that exposed Ms. Emmanson’s nudity, noting that this amounted to a criminal invasion of her privacy. It pledged to offer her free legal representation to ensure her rights are protected and that she receives appropriate redress.

“It is deeply disturbing that Ms. Emmanson was forcibly removed from the aircraft, stripped of her clothing in public, and subjected to humiliation that was filmed and circulated online,” the statement read. “Such conduct is degrading, violates her right to dignity and privacy, and falls far short of the standards of civility and professionalism expected in the aviation sector. No person, regardless of the circumstances, should be treated in such a dehumanising manner.”

The NBA highlighted that while Ibom Air had released its own account, other footage showed a flight attendant preventing Ms. Emmanson from leaving the plane, an act that could constitute false imprisonment and possible provocation. This, it argued, made it essential for the matter to be subjected to an impartial review before any disciplinary measures were enforced.

It further insisted that only the appropriate statutory aviation regulator has the legal authority to suspend or restrict a passenger’s right to fly, not private associations or airlines acting on their own. The association described the circulation of unedited, indecent images as a breach of privacy and human dignity, noting that even if the incident had to be reported, the footage should have been blurred to protect the passenger.

The NBA demanded that Ibom Air retract the lifetime ban, issue a public apology, and fully cooperate with an independent investigation. It also called on the Minister of Aviation, the Nigerian Civil Aviation Authority, the Federal Airports Authority of Nigeria, and relevant security agencies to investigate the incident thoroughly, sanction those found culpable, and enforce compliance with humane treatment standards for air passengers.

Reaffirming its commitment to defending citizens’ rights, the NBA stressed that it would not remain silent while any Nigerian’s dignity is trampled upon by either public authorities, corporations, or individuals. “Respect for human dignity and the rule of law must never be compromised, and in this matter, justice must prevail,” it concluded.
