The Nigerian Civil Aviation Authority (NCAA) has imposed sanctions on Kenya Airways, citing multiple breaches of consumer protection regulations. The penalties stem from incidents involving Nigerian passenger Gloria Omisore and two others, highlighting systemic issues in the airline’s handling of passenger rights, refunds, and baggage policies.
The NCAA’s action underscores a growing emphasis on accountability within Nigeria’s aviation sector, as regulators tighten enforcement to protect travelers.
According to a press statement released by Michael Achimugu, NCAA’s Director of Public Affairs and Consumer Protection, Kenya Airways has been fined for a range of violations, including:
Failure to provide adequate passenger care: The airline neglected to offer appropriate support to passengers facing disruptions, such as extended layovers and flight delays.
Non-disclosure of terms of carriage: Kenya Airways failed to fully inform passengers of their rights and the conditions of their travel.
Delayed or absent responses to NCAA inquiries: The airline repeatedly ignored or inadequately addressed requests from the regulator for clarification and compliance.
Failure to process refunds and compensation: Affected passengers, including Gloria Omisore, were neither refunded nor compensated as required.
Mishandling of lost baggage: The airline’s mishandling of passenger luggage further compounded traveler grievances.
The NCAA has mandated Kenya Airways to pay refunds and compensation equivalent to 1,000 Special Drawing Rights (SDR) to the affected passengers within seven days. Non-compliance, the authority warned, will trigger harsher penalties, signaling a no-tolerance stance on consumer rights violations.
The case of Gloria Omisore has become a focal point of the NCAA’s enforcement efforts. Omisore’s ordeal began when Kenya Airways failed to verify her lack of a France transit visa before allowing her to board a flight to Nairobi.
Upon arrival, she faced a grueling 17-hour layover, only to be informed of an additional 10-hour wait to continue her journey to the UK. Omisore, who was reportedly menstruating and in need of basic hygiene facilities, requested care during this extended delay.
According to the NCAA, the airline’s response was inadequate, marked by poor passenger handling that fell far short of industry standards.
The NCAA refuted Kenya Airways’ initial public statement, which it described as “misleading” and an attempt to obscure the facts.
The regulator demanded that the airline revise its statement to reflect the truth and issue a formal apology, refund, and compensation to Omisore within 48 hours. Despite requesting a one-hour extension, the airline failed to comply, further escalating the dispute.
The NCAA’s sanctions also address broader issues with Kenya Airways’ operations. In one instance, the airline operated a flight delayed by seven hours without compensating affected passengers, in violation of NCAA regulations.
Additionally, Kenya Airways has been accused of failing to submit compliance reports and ignoring the regulator’s directives, a pattern that has eroded trust in the airline’s commitment to passenger welfare.
The NCAA’s February announcement of “maximum enforcement action” against Kenya Airways foreshadowed the current sanctions. At the time, the regulator signaled its intent to crack down on repeated infractions, with Omisore’s case serving as a high-profile example of the airline’s shortcomings.
