Summary
The United States military announced on Monday that it is considering placing Democratic senator and former astronaut Mark Kelly before a court-martial after he appeared in a viral video advising service members to refuse any “illegal orders.”
The Pentagon’s review represents a dramatic escalation in the Trump administration’s ongoing confrontation with six Democratic lawmakers who participated in the widely circulated message. All six have backgrounds in either the military or intelligence services, a detail that has intensified the administration’s scrutiny.

Kelly—a retired Navy combat pilot and celebrated astronaut who once commanded the Space Shuttle Endeavour on its final mission—responded defiantly, declaring that he would not be intimidated nor “silenced by bullies.”
According to military officials, the Department of Defense had even warned that Kelly could be recalled to active duty specifically so he could be prosecuted under the Uniform Code of Military Justice. Authorities suggested that his participation in the video may have compromised the “loyalty, morale, or good order and discipline of the armed forces,” citing regulations that prohibit any behavior capable of disrupting internal cohesion.
The move is especially rare, given the Pentagon’s long-standing avoidance of overt political entanglements until President Donald Trump’s return to office earlier this year. Publicly threatening a sitting United States senator has been described by observers as nearly unprecedented.
The video, released on Friday, featured Kelly, Michigan Senator Elissa Slotkin, and four Democratic members of the House of Representatives. They collectively urged military personnel to “refuse illegal orders,” though they did not specify what directives they were referencing.

President Trump reacted harshly, alleging that the group engaged in “seditious behavior, punishable by death.” Over the weekend, he intensified his rhetoric in a social media post written entirely in capital letters, claiming the “traitors” who encouraged troops to reject his instructions “should be in jail.”
‘Acting like fascists’
While the Democrats did not detail which orders they considered unlawful, Trump has deployed the National Guard to several US cities at times in defiance of objections from local authorities insisting it was necessary to quell what he describes as widespread unrest.
Internationally, he has authorized military actions targeting suspected drug-smuggling vessels in the Caribbean and eastern Pacific. These operations have resulted in more than 80 deaths and have generated considerable controversy, with experts arguing that the strikes violate international law.
Defense Secretary Pete Hegseth condemned the lawmakers, labeling them the “Seditious Six” and calling their message “despicable, reckless, and false.” He claimed that Kelly undermined the integrity of the armed forces by addressing troops directly while identifying himself by rank, which, according to Hegseth, lent his statements undue weight and influence.
However, analysts and supporters of the Arizona senator have warned that the Pentagon’s aggressive stance could ultimately strengthen Kelly’s public profile, especially as political watchers speculate about his potential interest in the 2028 presidential race.
Kelly responded by posting a photograph showcasing his numerous military decorations and recounting his years of service in both the Navy and NASA. He insisted that he would not be deterred from “holding this administration accountable.”
“I’ve given too much to this country to be silenced by bullies who care more about their own power than protecting the Constitution,” he said.

Arizona’s other senator, Ruben Gallego, himself a veteran of the Iraq War, released a fierce, profanity-filled video in which he criticized the Pentagon’s announcement as “insane.” He accused Hegseth and other officials of “acting like fascists” and defended Kelly as a patriot performing his duty by reminding service members of their rights.
“Mark Kelly is a patriot. There’s no reason why they’re going after him,” Gallego said. “He was doing his duty and just reminding people about their rights as service members.”
What You Should Know
This situation marks a historically rare clash between the Pentagon and a sitting senator, driven by a politically charged video urging troops to reject unlawful commands.
The controversy highlights growing tensions between the Trump administration and Democratic lawmakers with military backgrounds.
Mark Kelly’s long service record, including distinguished careers in both the Navy and NASA, is central to the debate, as critics argue the Pentagon’s threat could elevate him politically while supporters frame the move as an attempt to intimidate dissenting voices in government.
